Terms and Conditions
1. Website Development
Hosting and Domain: I do not provide website hosting or domain registration services. Clients are responsible for selecting and managing their own hosting and domain providers. I’m happy to offer guidance during the selection process if needed.
Client Responsibilities: The Client agrees to supply all required content, branding materials, and timely feedback. Delays in providing these assets or approvals may result in project delays and could incur additional charges.
Third-Party Assets: Any third-party resources used (e.g., stock photography, fonts, plugins) are subject to their own licensing agreements. It is the Client’s responsibility to review and comply with these licenses.
Limitations and Liability: I am not responsible for delays or issues caused by third-party providers, including hosting platforms, domain registrars, plugins, or theme limitations.
Cybersecurity guidance is not provided as part of this service. Clients are responsible for consulting their chosen hosting provider regarding security measures and best practices.
After Website Delivery
Ongoing Hosting and Domain: Clients are responsible for ongoing hosting and domain management, including timely renewals and payments to avoid service interruptions. If issues arise, I can assist by liaising with your service provider.
Backups: I do not maintain backups of client websites unless you are subscribed to my monthly website maintenance plan.
Maintenance: Clients not enrolled in a maintenance plan are responsible for requesting any necessary updates, including CMS, theme, or plugin updates. I am not liable for issues resulting from unmaintained software.
End of Responsibility: If the client is not on a monthly maintenance plan, my responsibility ends once the website or any requested work is completed. You’re always welcome to reach out if you need help — I’ll do my best to assist.
2. Graphic and Other Design Projects
Content and Copyrights: Clients must provide all text, images, and other materials required for the design. By submitting these materials, the Client confirms they have the right to use them and that they do not infringe on any third-party rights. The Client assumes full responsibility for copyright compliance of supplied content.
3. Cancellations and Termination
Termination Rights: Either party may terminate the agreement at any time. However, due to the hourly billing structure, all paid invoices are non-refundable.
Grounds for Termination: I reserve the right to terminate the project in the event of non-payment, violation of these terms, or ongoing uncooperative behavior.
4. Limitation of Liability
I shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the website or services, including (but not limited to) downtime, data loss, or security breaches.
The Client is fully responsible for protecting their login credentials.
The Client is also responsible for maintaining regular backups of their website or data, unless they are enrolled in a maintenance plan.
5. Agreement
By engaging my services, the Client acknowledges and agrees to the terms outlined above.
